Terms of Service — FoodyMaxx

These Terms govern the use of FoodyMaxx.com and its restaurant POS software and services (“FoodyMaxx”).

1. Services

FoodyMaxx provides cloud-based restaurant management software, including POS functionality, order processing, employee scheduling, reporting, kiosk support, and catering integration.

2. License Grant

We grant you a limited, non-exclusive, non-transferable license to use FoodyMaxx software during your subscription period.

You may not:

• Reverse engineer or modify the software
• Resell or sublicense access
• Use the platform outside its intended purpose

3. Restaurant Data

You retain ownership of your restaurant data, including menus, orders, and reports. By using FoodyMaxx, you grant us permission to process data solely to provide services.

4. Fees & Billing

• Subscription fees are billed according to your plan
• Failure to pay may result in suspension
• Fees are non-refundable unless required by law

5. System Availability

While we strive for high uptime, FoodyMaxx does not guarantee uninterrupted service. Maintenance, updates, or external factors may cause temporary outages.

6. Integrations

FoodyMaxx may integrate with FoodyXpress and third-party services. We are not responsible for failures caused by third-party systems.

7. Limitation of Liability

• Lost revenue or business interruptions
• Data loss caused by factors outside our control
• Hardware malfunctions not provided by us

Total liability is limited to fees paid in the preceding 12 months.

8. Termination

Either party may terminate service according to the subscription agreement. Upon termination, access to the software ends.

9. Governing Law

These Terms are governed by the laws of the State of California.
